What happens after filing?

UKIPO examines the application and searches for earlier marks. If issues are raised, there is usually an opportunity to respond. Accepted applications are published in the Trade Marks Journal for two months so third parties can oppose. If no opposition succeeds, UKIPO registers the mark.

Before you apply

Can a non-UK resident own a UK trade mark?

Yes. An overseas individual or company can apply, although UKIPO correspondence and representation requirements may depend on the applicant’s circumstances.

Does the £205 fee include every class?

No. It covers one class in a standard online application. Each extra class adds £60 to the official fee.

How long does registration take?

Timing varies. Even a straightforward application must pass examination and the two-month publication period. Objections or opposition make the process longer.

Should I register a word or a logo?

A word mark and a logo protect different things. A word mark is often broader for the name itself; a logo filing protects the graphic representation submitted. Some brands file both separately.

Can you guarantee there is no conflict?

No search can guarantee that. Similarity, reputation, unregistered rights and the exact goods or services can all affect risk.

What is not included?

Complex objections, oppositions, hearings, overseas filings and specialist legal opinions are outside the displayed package unless separately agreed.
